Terms and Conditions
Please read these Terms and Conditions ("Terms") carefully, together with our privacy policy. By placing an order with us Dalebrook Supplies Limited (Registered number 2770125) trading as DaleBrook, Registered Office at 13-17 New Burlington House, 1075 Finchley Road, London NW11 OPU, you are indicating your agreement to be bound by these Terms and you reaffirm that agreement each time you order items from us ("Goods").
GENERAL
We reserve the right to reject any order made by you.
We may change these Terms from time to time without notice to you and any subsequent orders from you will be subject to those changes. Any changes to these Terms proposed by you shall only be effective if expressly agreed by us in writing.
PRICE
Prices quoted on our website are in pounds sterling, are exclusive of VAT and delivery charges and may change from time to time. There is a 1.5% supplement charge for the use of credit cards.
VAT is payable at the rate current when you place your order. Delivery charges are charged at a flat rate. Expedited deliveries may incur additional charges, which will be agreed in advance between you and us.
PAYMENT & TITLE
The Goods remain our property until all sums due to us have cleared. Payment may be made by the following methods: personal cheque, company cheque, banker's draft, credit or charge/debit card, or such other method as may be agreed in advance with us.
You agree that we, or our representatives may enter your premises at a reasonable time in order to recover the Goods originally supplied by us for which payment is outstanding beyond any previously written agreed credit term.
DEFECTIVE / RETURNED PRODUCTS You shall inspect all Goods immediately when they are delivered. Any goods returned to us for any reason must be returned with original packaging, a copy of the original invoice and in a clean condition together with the 10 digit order confirmation number. Non-faulty Goods returned more than seven days after delivery will, at our discretion, either be refused or be subject to a restocking fee to cover our expenses.
DELIVERY
We will make all reasonable endeavours to deliver the Goods as instructed by you. Normal delivery times are Monday to Friday 8am to 6pm excluding UK public holidays, other delivery times are available by prior arrangement and may be subject to additional charges.
MANUFACTURER'S LICENCES
We accept no responsibility or liability for any licence entered into between you and a manufacturer of the Goods or any part of the Goods.
FORCE MAJEURE
We reserve the right to cancel, suspend or vary the operation of our obligations to you if events occur which are in the nature of force majeure including (but without prejudice to the generality of the foregoing) fire, flood, storms, plant breakdown, strikes, lock outs, riot, hostilities, non-availability of material or suppliers or any other event outside our control; and we shall not be held liable for any breach of contract or in tort including delict resulting from such an event.
DATA PROTECTION
The Company will use any personal data (as defined in the Data Protection Act 1998) it has about you in accordance with its privacy policy and the Data Protection Act 1998.
LIABILITY
Except as otherwise provided in these Terms, and except where the Goods are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law. Our liability (if any) under these Terms in respect of any defect in the Goods or of any duty owed to you under the Terms shall be limited to the sale price of the Goods.
Where you are a person dealing as a consumer, nothing in these Terms shall affect your statutory rights.
GOVERNING LAW AND JURISDICTION
The Terms shall be governed by and constructed in accordance with the law of England and you agree to submit to the exclusive jurisdiction of the English Courts.
